Welcome to UtilityMart. These Terms and Conditions ("Terms") apply to your use of utilitymart.shop (the "Website") and to every order you place with us. By using the Website or placing an order you agree to these Terms. If you do not agree, please do not use the Website.

1. Who we are

UtilityMart is an online shop for household utilities including but not limited to cleaning supplies, hardware fittings, repair and renovation tools, gardening supplies and tools, pc building and repair tools, car care supplies and tools, power tools, operated by HMBR Tools And Chemicals LTD ("UtilityMart", "we", "us", "our"), with its address at Holding #13, Road #01 (Dhaka Bypass Road), Ward #40, Area #02, Kudabo (Mirer Bazar), Pubail, Joydebpur, Gazipur - 1721, Bangladesh. These Terms should be read together with our Privacy Policy, Shipping and Delivery Policy, Refund and Return Policy, Cancellation Policy and Payment Policy. They form part of these Terms.

2. Using the Website

  • You must be at least 18 years old, or use the Website with the involvement of a parent or guardian, to place an order.
  • You must give accurate and complete information when you order or create an account: your name, a working Bangladeshi mobile number, and a delivery address that the courier can find.
  • If you create an account, you are responsible for keeping your password secret and for everything done through your account. Tell us at once if you think someone else has used it.
  • You must not misuse the Website: no attempts to break or overload it, no automated ordering or scraping, no fake or abusive orders, and no use that breaks the law.
  • We may suspend or close an account, or refuse an order, where we reasonably believe these Terms have been broken or an order is fraudulent.

3. Products and product information

We try to describe our products, sizes, quantities and prices as accurately as we can. Photographs are for illustration; colours on your screen may differ slightly from the real product, and packaging may change from time to time. Product pages show the size or quantity of what you will receive.

Many of our products are cleaning chemicals, tools and hardware. You must read and follow the label and instructions, use them only for their intended purpose, keep chemicals away from children, and never mix cleaning products. We are not responsible for harm caused by use that goes against the label or instructions.

Availability is shown on the Website but is not guaranteed until we confirm your order. If an item turns out to be unavailable we will tell you and refund anything you have paid for it.

4. Prices

All prices are in Bangladeshi Taka (BDT) and include VAT. The delivery charge is shown separately at checkout before you pay. We may change prices at any time; the price that applies is the one shown when you place your order. If we notice an obvious pricing error we may cancel the order and refund you in full, or offer to supply the product at the correct price, and you may choose which.

5. Orders and our contract with you

  • When you place an order you make an offer to buy. We confirm that we have received it by an on-screen confirmation, an SMS and, if you gave an email address, an email. This is not yet our acceptance.
  • A contract is formed when we confirm your order and dispatch it, or accept it by telephone or message. We may call you to confirm the order and the delivery address.
  • For your first cash on delivery order we may ask you to confirm your mobile number with a one-time code sent by SMS. This protects you and us from orders placed with someone else's number.
  • We may refuse or cancel an order, for example if an item is out of stock, a price is wrong, the address cannot be served, we cannot reach you, payment is not confirmed, or we suspect fraud. If we cancel after you have paid, we refund you in full as set out in our Refund and Return Policy.

6. Payment

You can pay by cash on delivery or online (bKash, Nagad, Rocket, cards and internet banking) through the SSLCOMMERZ payment gateway. How payment works, how we keep it secure and what happens if a payment fails are explained in our Payment Policy.

7. Delivery, ownership and risk

We deliver primarily through Pathao Courier (You will be informed in advance if any other delivery service is used). Charges, areas and delivery times are in our Shipping and Delivery Policy. The products remain ours until they have been delivered to you and, for online orders, paid for. Risk of loss or damage passes to you when the parcel is delivered to you or to the person at your address who accepts it. Please check your parcel when it arrives and tell us about any problem straight away.

8. Returns, refunds and cancellations

You may return products within 7 days of delivery on the conditions in our Refund and Return Policy, and cancel an order as set out in our Cancellation Policy. These policies do not affect your rights under the law, including the Consumer Rights Protection Act, 2009.

9. Product safety and warranty

Where a product comes with a manufacturer's warranty, it is described on the product page or in the pack, and we will help you make a claim. Products that are faulty, damaged or not as described when delivered can be returned as explained in the Refund and Return Policy.

10. Intellectual property

The Website, including its design, text, logos, images and software, belongs to us or our licensors and is protected by law. UtilityMart, Zepto, GI and other brand names, logos and product names shown are the property of their owners. You may view the Website and print pages for your own personal use, but you must not copy, reproduce, sell or reuse its content for commercial purposes without our written permission.

11. Our responsibility to you

We are responsible for supplying products that match their description and are fit for normal use. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, or your rights as a consumer. Subject to that, we are not liable for loss that was not a reasonably foreseeable result of our breach, for loss of profit or business, or for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, hartals, road closures, courier or network failures, or government action. If such an event happens we will tell you and you may cancel an undelivered order for a full refund. Our total liability for any order is limited to the price you paid for it, except where the law does not allow this limit.

How we collect and use your information is explained in our Privacy Policy.

13. Governing law and disputes

These Terms and any dispute about them or about an order are governed by the laws of Bangladesh. If you have a complaint, please contact us first; we will try to resolve it quickly and fairly. If we cannot agree, the courts of Bangladesh with jurisdiction over the matter will decide it.

14. Changes to these Terms

We may update these Terms from time to time. The version on the Website on the day you place an order applies to that order. The date at the top shows when they were last changed.
